Terms & Conditions

Welcome to Chicago Foam Guy, LLC! To ensure a smooth and safe experience, please review and agree to the following terms and conditions.  By proceeding with booking, the Client acknowledges that they have read, understood and agree to abide by the terms outlined in the Booking Agreement and Liability Waiver. The Client accepts full responsibility for their event and agrees to release Chicago Foam Guy, LLC from all liability associated with their event. 

Booking Agreement

By booking an event with Chicago Foam Guy, LLC, the client ("Client") agrees to these terms and acknowledges that this document serves as a legally binding contract. This agreement covers liability, setup procedures, policies, and cancellation terms. 

Liability Waiver

Assumption of Risk. Chicago Foam Guy, LLC is committed to an experience with utmost safety; however, the nature of our activities may carry inherent risks. By booking services, the Client acknowledges and accepts all risks associated with the use of our equipment, event activities, and participants. 

Liability Disclaimer. Chicago Foam Guy, LLC, including all of its employees, subcontractors, and affiliates, is not responsible for any accidents, injuries, or damages that may occur during the event. The Client assumes full responsibility for all guests and participants, and the Client agrees to release and hold harmless Chicago Foam Guy, LLC from any claims arising from the event. 

Client's Liability. The Client accepts all liability for damages, injuries, and accidents that may occur during the event. The Client is responsible for ensuring a safe environment and surrounding area for all guests and participants. Chicago Foam Guy, LLC assumes no liability for incidents resulting from unsafe or unsupervised activities. 

Setup Procedures

Chicago Foam Guy, LLC is responsible for the timely setup, takedown and monitoring of all equipment. The Client agrees to provide adequate space and access for setup. Chicago Foam Guy, LLC will maintain, clean and inspect all equipment prior to the event. The Client, guests and participants agree to not modify, move, or adjust any equipment provided to ensure use of equipment properly. 

Any restrictions or obstructions that prevent proper setup could result in partial services and/or liability of an unsafe environment which is the responsibility of the Client. 

Weather and Cancellation Policy

While weather can be unpredictable, if rain or inclement weather is forecasted, please notify us as soon as possible to reschedule your event. If the event is canceled prior to setup due to weather, we will be happy to reschedule to a mutually agreed-upon date, subject to availability. If the event is canceled due to weather after setup has started, Chicago Foam Guy, LLC has the right to cancel or stop the event if conditions become unsafe. No refunds are provided once the event setup has been completed. 

Chicago Foam Guy, LLC will not offer a refund on deposits. However, we will assist with rescheduling your event where we can apply the deposit to a new date subject to availability. 

Terms
By attending an event where Chicago Foam Guy, LLC was hired, attendees are granting permission to photograph or video participation to be used for promotional purposes, unless otherwise specified by the Client in writing. 

Any changes or amendments to this agreement must be made in writing and agreed upon by both parties.
